A FOIA request does not require an initial fee, and in some cases, no fees are charged.
SCD will provide an estimate of the expected charges and an itemized estimate of the cost associated with the FOIA request before the request is completed. Upon receiving the estimate, the requesting party may choose to proceed with the request or revise it.
- Photocopying Fees
Standard-sized, black-and-white copies: Public bodies may not charge citizens for the first 20 pages of standard-sized, black-and-white copies. The charge for copying standard-sized, black-and-white public records for copies over and above 20 is $0.10 per sheet ($0.20 for a double-sided sheet). This charge applies to copies on the following standard paper sizes: 8.5" x 11", 8.5" x 14", and 11" x 17".
Oversized copies/printouts: The charge for copying oversized public records is as follows: 18" x 22", $2.00 per sheet; 24" x 36", $3.00 per sheet; documents larger than 24" x 36", $1.00 per square foot.
Color copies/printouts: An additional charge of $1.00 per sheet is to be assessed for all color copies or printouts for standard-sized copies (8.5" x 11", 8.5" x 14", and 11" x 17") and $1.50 per sheet for larger copies. - Administrative Fees
The first hour of research is free. Anything above and beyond an hour may be billed per quarter hour at $20 per hour or $5 per every 15 minutes over the initial first hour of research. - Electronically Generated Records
Charges for copying records maintained in an electronic format will be calculated by the material costs involved in generating the copies (including but not limited to DVD, CD, or other electronic storage costs) and administrative costs.

The Delaware Freedom of Information Act (29 Del. Code, Chapter 100), generally referred to as “FOIA,” ensures that the public has easy access to public records held by the Sussex Conservation District (SCD).
All FOIA requests must be in writing and adequately describe the records sought in sufficient detail to enable SCD to locate such records with reasonable effort. The requesting party must be as specific as possible when requesting records. To assist SCD in locating the requested records, the Sussex Conservation District may ask that the requesting party provide additional information such as the types of records, dates, parties to correspondence, and subject matter of the requested records.
Information needed in the request:
- File to be viewed (by project name)
- Reason for viewing a file.
- Contact information completed in its entirety.
When possible, all records will be sent electronically. If copies are requested, a fee may apply.
