Residential, Commercial, and Industrial projects that disturb 5,000 square feet are required to submit a Sediment and Stormwater Management Plan. (Municipality, County, and Non-profit organizations included)

Stormwater Maintenance Inspection Fee
The Sussex Conservation District is responsible for inspection of the stormwater facilities
for perpetuity. Entire maintenance fee collected is not to exceed $5,000.
Stormwater facilities such as ponds, under-ground
systems, and structural water quality facilities. (Connected ponds will not be considered as one facility.)

“Green Technology” Stormwater Projects
where water quality is treated through the use of
bioswales, and bio-retention.

Detailed Plan Re-Review Fee
The District may assess another review fee for a project when the following occurs:
1. Significant changes in the manner runoff is managed or the site grading
is re-configured to change how quantity/quality treatment is provided.
2. When a project is reviewed three times and continues to not comply with the State
Regulations,the District’s checklist or is non-responsive to the District’s comment letters.
3. Any revisions to an approved project that constitutes the District re-reviewing the stormwater calculations.
4. Review of phased Erosion and Sediment Control Plans that have an approved stormwater management plan.

  • Projects that will not disturb 5,000 square feet are exempt from the Delaware’s Sediment and Stormwater Regulations and are not required to submit a plan to the District.
  • The review, inspection, and maintenance fee is to be paid prior to receiving District approval. Please note that the review fee is to be paid at the initial plan submittal and the remaining fees can be collected at a later date, however, they must be received prior to receiving District approval.
  • A Sediment and Stormwater Approval is valid for 3 years from the date that is stamped on the approved plans. If an approved project is never constructed, the developer may request a refund of the maintenance and inspection fee prior to the project expiring. Please note: under no circumstance will a refund be granted for a project that was initiated but was never completed.
  • Projects that are greater than 50 acres and are phased developments have the option of paying the entire inspection and maintenance fee or may pay the inspection and maintenance fee for the current phased development. For example:
  • 100-acre project – Stormwater Master Plan Review................$3,500 Review fee
    Phase 1A of 100-acre project (20 acre)...................................$750.00 Re-Review Fee
    Phase 1A Inspection Fee (20 acres).........................................$4,000.00 Inspection Fee
    Phase 1A Maintenance Inspection Fee (1 Pond).......................$500.00 per facility

    Please note that the fee schedule will be re-evaluated in 3 years from the date of adoption and you may be subjected to paying higher fees if you chose the latter of the two options.
